Congratulations on buying your new home! Purchasing a new place to live can be a stressful time. At Gerber & Gerber, we want you to know what to expect at your closing. Here are the basic steps for a successful closing:

  • Closings typically take an hour or less, depending on how much detail each party to the transaction wishes to go into about each legal aspect of the closing. The HUD1 settlement statement will be gone over in detail. We will also go over each loan document with you as the purchaser (unless it is an all cash purchase) and transfer documents with the seller.
  • Gerber & Gerber will be responsible for preparing the HUD1 settlement statement, Warranty Deeds, Seller’s Affidavits, title insurance paperwork and any other paperwork needed to transfer the title of your property.
  • If you or anyone else legally on the purchase agreement are unable to attend the closing, a Power of Attorney form will need to be completed prior to the closing date.
  • You will need to bring the following to closing (for each person listed as a property purchaser):

– Photo ID, such as a driver’s license or passport, as well as a second form of ID such as an insurance card or military ID.

– Social security number (or federal tax ID number)

– Original documents that have been requested by our firm, your agent or the lender

–  Contact information for your lender if you are purchasing with a loan.

– Funds – Georgia law prohibits law firms from taking amounts over $5,000, so if you are required to bring funds in excess of this amount, we will need your account information so funds can be wired into our escrow trust account. Certified funds, such as a cashier’s check made out in your name, are required for amounts between $1,000 and $5,000. Any other payoffs or closing fees under $1,000 can be paid with a personal check.

– Termite letter and/or home warranty, if applicable.

  • Each party will sign the required documents (note, as the buyer, you will have far more documents to review/sign than the seller).
  • We will make copies of all documents, collect and disburse all funds (mortgage payoff, seller funds, agent commission checks, if applicable), and the keys will then be presented to you as the new property owner.
